END-USER TERMS

These End-User Terms apply when you use a solar calculator, proposal flow, embedded widget or AI assistant powered by Solarise (the Tool). They form an agreement between you and Solarise only for your use of the Tool. Please read them before continuing. By using the Tool after these terms are made available to you, you agree to them. If you do not agree, do not use the Tool.

The Tool is provided by Solarise Technologies d.o.o., registration number 22021168, tax identification number 114420359, Fruškogorska 1, 21000 Novi Sad, Serbia (Solarise, we, us or our). The solar installer, retailer or other business identified in the Tool is the Solar Business.

1. SOLARISE'S AND THE SOLAR BUSINESS'S ROLES

Solarise supplies the software used by the Solar Business. Unless the Tool clearly says otherwise, Solarise does not sell, design, finance or install your solar system and is not the Solar Business's agent. The Solar Business decides whether to offer you products or services and on what terms. Any consultation, site survey, quotation, installation, warranty, financing or customer contract is between you and the Solar Business and is governed by its terms.

Questions about a proposed installation, price, products or service should be directed to the Solar Business. Questions about the operation of the Solarise software may be sent to us using the contact details below.

2. PRELIMINARY ESTIMATES ONLY

Results may use the information you provide together with satellite or aerial imagery, mapping, weather, tariff, product and other third-party data. Unless the Solar Business expressly identifies a particular document as its final or binding offer, results are preliminary estimates for information and sales-support purposes. They are not a guarantee of system size, generation, savings, payback, price, eligibility, incentives, grid connection, finance approval or installation feasibility. Any binding offer is made by the Solar Business, not Solarise, and is subject to the acceptance requirements and terms stated in that offer.

Images and datasets may be old, incomplete or inaccurate, and actual conditions such as shading, roof structure, wiring, local requirements, tariffs, incentives and energy use may differ or change. Before an installation or other safety-critical reliance, ensure that appropriate qualified professionals complete the necessary site assessment, engineering review and final design. Do not rely on the Tool as engineering, structural, electrical, financial, legal or safety advice.

3. AI ASSISTANT

If you use the chat feature, its responses are generated by an AI system, not a person. AI responses can be inaccurate, incomplete or outdated. Do not use the AI assistant for an emergency or a safety-critical decision. Verify important information with the Solar Business or another qualified professional.

Do not submit passwords, payment-card details, unnecessary sensitive personal data, confidential information belonging to another person or information you are not authorised to share.

4. YOUR INFORMATION

The Solar Business typically decides why information submitted through its Tool is collected and used. Solarise processes that information to provide the Tool on the Solar Business's behalf. Solarise also processes certain information for the operational, security, support, analytics and legal-compliance purposes described in our Privacy Policy. Please read the Solar Business's privacy notice and the Solarise Privacy Policy.

You confirm that information you submit is accurate to the best of your knowledge and that you are authorised to provide it. If your privacy request concerns a lead or proposal, contact the Solar Business first. Using the Tool may send your information to the Solar Business so it can respond to your request. These terms do not by themselves constitute consent to receive electronic marketing.

5. PERMITTED USE

You may use the Tool for your own legitimate evaluation of solar products or services and to communicate with the Solar Business. You must be legally capable of agreeing to these terms. The Tool is not directed to children. You must not:

  • use the Tool unlawfully, deceptively or to harm another person;
  • interfere with security or operation, introduce malicious code, scrape the Tool at scale or bypass access and usage controls;
  • impersonate another person or submit information without authority; or
  • copy, reverse engineer, resell or exploit the Tool except where law expressly permits it.

6. INTELLECTUAL PROPERTY

Solarise and its licensors own the Tool, software, interface, models, templates and related intellectual property. The Solar Business or its licensors owns its branding and content. While the Tool is made available to you and you comply with these terms, you receive a limited, non-exclusive, non-transferable permission to use it for the purposes described here. No ownership rights are transferred to you.

7. AVAILABILITY AND THIRD-PARTY SERVICES

The Tool's availability and configuration may depend on the Solar Business and on mapping, imagery, AI, communications and other third-party services. We or the Solar Business may update the Tool or restrict access where reasonably necessary for security, maintenance, legal compliance, suspected misuse or operational reasons. We do not promise uninterrupted or error-free availability or that every feature will remain available. Links or integrations provided by the Solar Business or a third party are governed by that party's terms. This section does not limit any mandatory rights you have in relation to a digital service.

8. RESPONSIBILITY AND MANDATORY RIGHTS

The Tool is intended to support an initial solar-sales process. Because estimates depend on inputs, assumptions and changing third-party data, Solarise does not promise that a preliminary estimate or AI response is complete, accurate or suitable for a particular purpose or that it will produce a particular result.

Solarise is not responsible for the Solar Business's products, services, advice, pricing, installation, financing, warranties or contracts, except to the extent a loss is caused by Solarise's own breach or applicable law provides otherwise.

To the extent permitted by law, Solarise is responsible only for loss that is a reasonably foreseeable result of our breach of these terms or failure to exercise the care required by law. We are not responsible for loss caused by materially inaccurate information supplied by you or the Solar Business, use contrary to the warnings in these terms, or a third-party service outside our reasonable control. This does not reduce our responsibility to the extent Solarise contributed to the loss.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence. Nothing limits mandatory consumer rights or remedies you may have against Solarise or the Solar Business. Those rights may include non-waivable rights relating to the conformity, supply or modification of a digital service, including where applicable law treats personal data as the counter-performance for that service.

9. SUSPENSION AND CHANGES

We or the Solar Business may restrict access if reasonably necessary for security, maintenance, suspected abuse or legal compliance. Any restriction will be proportionate to the reason where applicable law requires it. We may update these terms. Updated terms apply only prospectively from their effective date. The date above identifies the current version, and we will provide clear advance notice of a material change where required by law. A change to the Tool or these terms does not limit any termination, conformity or other mandatory remedy that applicable law gives you.

10. GOVERNING LAW AND DISPUTES

These terms are governed by the laws of the Republic of Serbia, without depriving you of mandatory protections that apply in your country of residence. Nothing in these terms requires a consumer to bring or defend a claim only in Serbia or prevents a consumer from using any court that has jurisdiction under applicable law. You may contact us first so we can try to resolve a concern informally, but doing so does not prevent you from seeking a remedy or urgent relief available under law.

11. GENERAL

If a provision is invalid or unenforceable, the remaining provisions will continue to the extent permitted by law. An invalid or unfair term will not be replaced or interpreted in a way that deprives you of a mandatory right. Failure to enforce a provision is not a waiver. These terms do not create employment, partnership or agency between you and Solarise or between Solarise and the Solar Business.

12. CONTACT AND COMPLAINTS

Send a complaint about the operation of the Solarise software to the general contact below. Send a complaint about a solar product, service, quotation, installation, financing or warranty to the Solar Business. We will handle complaints and participate in an applicable consumer dispute-resolution process where required by law. You may also contact a competent consumer-protection authority or dispute-resolution body.
